Ranbaxy recalls generic Lipitor in United States

MUMBAI (Reuters) - Indian drugmaker Ranbaxy Laboratories Ltd has recalled its generic version of Pfizer Inc's cholesterol-lowering drug Lipitor in the United States after certain batches were found to contain glass particles.

Ranbaxy's U.S. subsidiary, Ranbaxy Pharmaceuticals Inc, said the recall affects certain lots of 10-, 20- and 40-milligram doses of the drug, known generically as atorvastatin calcium. The 80-milligram dosage is not affected.

The company is conducting an investigation which it expects will take two weeks. It did not report any injuries connected to the tainted pills and did not say how the problem was discovered.

The recall could cause shortages of the drug in the United States, analysts said. Ranbaxy, the first company to introduce generic Lipitor after Pfizer's patent expired in November 2011, controls about 60 percent of the market, according Ross Muken, an analyst at ISI Group LLC.

"Given its dominant share of this high-volume drug, we are certain to see supply shortages over the next two weeks," Muken said. The near-term impact is likely to be felt most by retail pharmacies and more modestly by wholesalers, he added.

The recall is the latest in a series of manufacturing problems at Ranbaxy, which is operating under heightened scrutiny following a long-running dispute with the U.S. Food and Drug Administration.

In 2008 the FDA banned the company from importing about 30 drugs after it found manufacturing deficiencies at two of the company's facilities in India. In 2009 the U.S. government accused Ranbaxy of falsifying data used in drug applications.

Last December, Ranbaxy agreed to make changes to its manufacturing plants in the United States and India. And it said it would set aside $500 million to resolve any potential civil or criminal charges stemming from an investigation by the U.S. Department of Justice.

Under a proposed settlement earlier this year, Ranbaxy agreed to engage a third party to conduct a review of its facilities, implement procedures to ensure data integrity in its marketing applications, and ensure it meets good manufacturing practices.

During its first six months on the market, when it enjoyed marketing exclusivity, atorvastatin generated sales of nearly $600 million for Ranbaxy, according to Bhagwan Singh Chaudhary, a research associate at the brokerage IndiaNivesh.

"The (recall) will impact the company's credibility," said Chaudhary. "A recall suggests corrective measures suggested by the U.S. FDA are not being implemented."

Other drugmakers, including Indian rival Dr. Reddy's Laboratories Ltd, have launched their own versions of Lipitor, and the market has become more competitive.

In 2008, Japan's Daiichi Sankyo Co acquired a majority stake in Ranbaxy in a deal valued at $4.2 billion.

Shares of Ranbaxy, which is valued at $3.93 billion, fell 3.3 pct to 496 rupees in Mumbai.

Talking tough, Netanyahu walks cautiously in Gaza conflict

JERUSALEM (Reuters) - Just hours after a bomb exploded on a Tel Aviv bus, Israeli Prime Minister Benjamin Netanyahu agreed to a truce with the very people his government blamed for the blast -- the Islamist Hamas rulers of Gaza.

Wednesday's decision to pull back from the brink of a full-scale invasion of the Gaza Strip despite the attack, which wounded 15 people, belies Netanyahu's international image as an uncompromising, bellicose hardliner.

Indeed, the eight-day campaign against Hamas militants in Gaza was the first major military operation he had ordered after seven years in power -- a remarkable record in a country that has repeatedly gone to war in its 64 year history.

"People don't realize that Netanyahu is trigger unhappy," said Ehud Yaari, an Israel-based fellow at the Washington Institute for Near East Policy.

"He is very cautious and very restrained. You could see that this past week. He set very well-defined boundaries and was very careful not to go wild," he added.

Opposition politicians were swift to portray this discretion as a failing, hoping that it will cost Netanyahu votes at a January 22 general election, which all opinion polls prior to the Gaza conflict had said he would win.

"The government displayed weakness and hesitancy in implementing its goals and the promise of achieving complete calm for the residents of Israel," said Yair Lapid, a television personality-turned-politician running in the January ballot.

Israeli daily Maariv also stuck the knife in, printing a cartoon showing a glum-looking Netanyahu carrying an object under his arm marked "backbone for rent".

A group of 16 soldiers marked their disdain by writing out "Bibi (is a) Loser", with their bodies and posting the photograph on Facebook. The image went viral and the army is investigating.

Despite the derision, it is unlikely the decision to avoid a potentially bloody land invasion of the densely populated Gaza Strip will cost Netanyahu the forthcoming election.

No opposition leader in the race comes close to Netanyahu in terms of experience or international stature, and Israel's biggest perceived security threat is still far from resolved -- Iran and its contested nuclear program.

IRAN IN FOCUS

Israel and its Western allies believe Iran is seeking to build nuclear weapons. Iran denies this, but Netanyahu says it is an existential issue for Israel and has promised to resolve the matter if he is elected to a third turn in office.

Known universally in Israel by his childhood nickname 'Bibi', Netanyahu has been so focused on Iran that critics at home said he had lost sight of the more immediate problem -- rising rocket fire out of Gaza and into southern Israel.

The Israeli military said Islamist militants had launched more than 700 missiles from Gaza in the first 10 months of the year. With elections looming, Netanyahu and Defence Minister Ehud Barak could not ignore the problem any longer.

The warplanes were sent in, killing Hamas's top military commander in an initial strike and targeting the group's large weapons arsenal thereafter. Some 162 Palestinians, including 37 children, and five Israelis died in the clashes.

"Both Netanyahu and Barak would have preferred not to go on this operation and only did so when the public made clear that enough was enough," said Einat Wilf, who sits on the Israeli parliament's foreign affairs and defence committee and is a member of Barak's Atzmaut party.

While Barak donned his black bomber jacket and toured the Gaza border lands to see the huge army mobilisation being readied for eventual invasion, Netanyahu stayed in his business suit and avoided eye-catching photo calls near the front line.

"This was deliberate. Netanyahu knew this would not end in the crushing defeat of Hamas because that wasn't ever the goal. He wanted to pose as the responsible adult at the top of the pyramid," said Washington Institute analyst Yaari.

INTERNATIONAL TIES

This stance is likely to have helped ease relations with the leaders of both the United States and Egypt.

The Arab Spring that brought an Islamist government to power in Cairo has raised concerns in Israel, which signed a peace treaty with Egypt in 1979.

Netanyahu has had famously testy ties with U.S. President Barack Obama and he was accused by some Democrats of trying to undermine Obama's re-election bid.

Dire predictions in the media that Netanyahu would suffer payback did not materialize during the conflict, with Obama fully endorsing what he called Israel's right to self-defence.

When Obama later said it was "preferable" to avoid an escalation, Netanyahu swiftly adopted the same language to show there was no daylight between the two leaders.

Likewise, his decision to rule out an invasion prevented a potentially disastrous diplomatic showdown with Cairo. Instead, he has got Egyptian backing as a guarantor of Hamas's ceasefire.

"There was no decisive victory here, said Giora Eiland, a former National Security Adviser. "But the situation was managed in the right way and it was clear that Israel enjoyed certain international support."

His lowkey handling of the conflict, peppered by regular meetings with key ministers, showed how Netanyahu has developed into a more consensual leader than in his first term in office from 1996 to 1999, when he lurched from one crisis to another.

"He is a policy wonk. He isn't a natural politician," said one of his close advisers, who declined to be named. "But he has come to realize that you need to listen to people and not just pretend. He has become a much more inclusive leader."

If, as expected, he secures a third term in January at the head of another rightist coalition, Netanyahu will once more push Iran to the top of the international agenda, with Gaza returning to its old position as an annoying irritant.

"If the Iranian threat is not neutralized in some way, then that will determine his legacy more than anything else," said the senior adviser.

BRUSSELS (AP) ? European leaders were staking out their strong positions as they gathered Thursday for what promises to be a turbulent and lengthy summit on the 7-year budget for the 27-country European Union.

In a battle pitting several wealthy member states against those seeking a bigger aid budget, U.K. Prime Minister David Cameron led the charge for those demanding a reduction in the financial clout ? and political sway ? of the EU's institutions.

As he arrived for a preliminary meeting with Herman Van Rompuy, president of the European Council of the 27 heads of state and government, Cameron said he was not happy with the latest budget proposals.

"These are very important negotiations," Cameron said. "And clearly, at a time when we're making difficult decisions at home over public spending, it would be quite wrong ? it is quite wrong ? for there to be proposals for this increased extra spending in the EU. So we're going to be negotiating very hard for a good deal for Britain's taxpayers and for Europe's taxpayers, and to keep the British rebate."

Facing an ever more vocal Euroskeptic electorate at home, Cameron is under huge pressure to veto any seven-year deal which would exceed the old 2007-2013 ?1 trillion ($1.28 trillion) budget.

The budget primarily funds programs to spur growth in the bloc's less developed regions and farming and amounts to about 1 percent of the EU's gross domestic product.

The European Commission, the EU's executive arm, backs more spending, arguing that cross-border initiatives will help to create the economic growth and jobs that the bloc of a half-billion people needs.

Cameron is the main proponent ? alongside the Netherlands, Sweden and, to a certain extent Germany ? for imposing limits on EU spending. He will demand a real cut in the EU budget, claiming that is the only justifiable outcome at a time when almost every member state has to cut its budget to lower debt.

Those opposing cuts to the budget say that European institutions need the means to implement their policies, which include creating jobs and economic growth, helping development in many southern and eastern nations, and closing the wealth gap between member states.

"Certain countries want to make drastic reductions in the budget. That's a big mistake," said Elio Di Rupo, Belgium's prime minister.

Sixteen of the EU's most financially and economically vulnerable countries have joined forces to oppose cuts to funds earmarked for economic growth and development. These countries include not only traditionally poorer member states, many in Eastern Europe, but also those hit hardest by the financial crisis, like Greece, Portugal and Spain.

Going into the open-ended summit, which might well stretch into Saturday, Van Rompuy made a first compromise proposal that leaned toward Cameron's demands. It proposes a cut of between ?3 billion ($4 billion) and ?24 billion ($31 billion), depending on how the figures are read.

"With less money, we cannot do the same as before," Van Rompuy wrote in the invitation letter he sent to the 27 leaders.

Since each of the 27 member states has veto power over the budget, the outcome is a cliffhanger.

Leaders from Denmark in the north to Spain and Italy down south have already threatened vetoes, sometimes for opposing reasons.

If the summit fails to find a compromise, the issue could spill over into a new meeting next month, or into next year. There is no set deadline for a deal but the closer it gets to 2014, the tougher it will be for a smooth introduction of new programs. If there is no deal up to 2014, there would be a rollover of the 2013 budget plus a 2 percent increase accounting for inflation.

Massive pileup shuts I-10 in Texas; 1 dead

BEAUMONT, Texas (AP) ? One person is dead and dozens are injured after an estimated 100-vehicle pileup that forced the closure of Interstate 10 in Southeast Texas.

KFDM-TV reports that the collision happened around 8 a.m. Thursday on I-10 near Beaumont, about 80 miles east of Houston.

Texas Department of Public Safety trooper Stephanie Davis says one person died after the crash, but declined to provide details. She says at least 100 cars and trucks crashed in extremely dense fog. Officials at Acadian Ambulance service tell KFDM that at least 48 people have been taken to area hospitals.

No deaths have been reported.

I-10 remains shutdown in eastbound lanes. Westbound lanes have reopened.

TRENTON ? New Jersey has signed onto a national letter urging Congress to extend tax relief for consumers who have mortgage debt canceled or forgiven because of financial hardship or a decline in housing values, Attorney General Jeffrey S. Chiesa announced today.

Chiesa is among 42 Attorneys General to sign the letter to U.S. House and Senate leaders. The letter urges federal lawmakers to extend the hardship-related tax exclusion, in effect the past five years, which would otherwise expire on Dec. 31.

Under the 2007 federal Mortgage Debt Relief Act, mortgage debt that is forgiven after a foreclosure or short sale, or through loan modification provided to a homeowner in financial hardship, may be excluded from a taxpayer?s calculation of taxable income. The exclusion applies only to mortgage debt forgiven on a primary residence.

The tax exclusion?s scheduled expiration comes at a time when many New Jersey homeowners, and homeowners nationwide, are benefiting from the $25 billion National Mortgage Settlement with the nation?s five largest loan servicing companies: Ally Financial, Bank of America, Citi, JP Morgan Chase and Wells Fargo. The joint state-federal settlement provides $17 billion in debt reduction and other relief to homeowners. Many other banks across the country also are offering mortgage modification and debt relief.

?It?s important that this tax exclusion be extended,? Chiesa said, ?so that the very consumers who can least afford it are not deterred from participating in the National Mortgage Settlement, or stuck with an unexpected tax bill for relief they received under the settlement, or through other debt relief programs.?

An extension of the hardship-related tax exclusion is included in the federal Family and Business Tax Cut Certainty Act of 2012, which recently passed out of the Senate Finance Committee with bipartisan support.

The trick, of course, is to blend this with genuinely interesting and
helpful copy. The best marketing jobs incumbents write all their copy on
the back of a thorough grounding in the habits and peculiarities of search
engines.

Engineered bacteria can make the ultimate sacrifice for the good of the population

ScienceDaily (Nov. 20, 2012) ? Scientists have engineered bacteria that are capable of sacrificing themselves for the good of the bacterial population. These altruistically inclined bacteria, which are described online in the journal Molecular Systems Biology, can be used to demonstrate the conditions where programmed cell death becomes a distinct advantage for the survival of the bacterial population.

"We have used a synthetic biology approach to explicitly measure and test the adaptive advantage of programmed bacterial cell death in Escherichia coli," said Lingchong You, senior author of the study and an associate professor at the Department of Biomedical Engineering, Duke University, and the Duke Institute for Genome Sciences & Policy. "The system is tunable which means that the extent of altruistic death in the bacterial population can be increased. We are therefore able to control the extent of programmed cell death as well as test the benefits of altruistic death under different conditions." The lead author of the study is Yu Tanouchi, a graduate student in the Department of Biomedical Engineering. Anand Pai and Nicolas Buchler also contributed to the work.

Scientists have known for some time that programmed cell death can be linked to the response of bacteria to stressful conditions, for example starvation of amino acids or the presence of competitor molecules. However, it is not clear why cells should choose to die under such conditions since it gives them no immediate advantages. Some researchers have suggested that programmed cell death allows cells to provide benefits to their survivors but until now it has been difficult to test this directly in experiments.

The researchers used synthetic biology procedures to engineer Escherichia coli in such a way that the bacterial cells are capable of suicidal behavior and promoting the good of the bacterial population. To do so they introduced a gene circuit, which consists of two modules, into the bacteria. If the "suicide module" is active it leads to the rupture and death of some bacterial cells when they are challenged with the antibiotic 6-aminopenicillanic acid. If the "public good" module is expressed, a modified form of the enzyme beta-lactamase is produced, which protects surviving cells from rupture or lysis by breaking down the antibiotic. This protection only occurs when the enzyme is released from inside the bacterial cells that make the ultimate sacrifice and die after rupture.

"Our results clearly demonstrate that it is possible to have conditions where the death of some bacteria confers an advantage for the overall population of bacteria," remarked You. "The optimal death rate for the bacterial population emerges after sufficient time has passed and is clearly visible in our system."

The scientists were also able to provide a possible explanation for the "Eagle effect," an unexpected phenomenon where bacteria appear to grow better when treated with higher antibiotic concentrations. "Overall our results fill in a conceptual gap in understanding the evolutionary dynamics of programmed bacterial death during stress and have implications for designing intervention strategies for effective treatment of bacterial infections with antibiotics," concluded You.

SAN FRANCISCO?-- E-commerce is expected to grow strongly this holiday season, spurred by early online deals, the rise of mobile devices and more free shipping offers.

Holiday sales will likely increase 16.4 percent from a year earlier, outpacing total retail sales, which are forecast to grow about 3.9 percent, according to analysts at Jefferies & Co.

Doug Anmuth, an analyst at J.P. Morgan, expects online purchases to top 10 percent of total U.S. retail spending for the first time in the fourth quarter.

"It's still early, but our sense is that we will have a really positive holiday season," said Joel Anderson, head of Walmart.com, the online business of Wal-Mart Stores Inc, the world's largest retailer.

Wal-Mart expects 600 million online visitors online during its holiday quarter, which runs from November through January. That is up 13 percent from the same period last year, according to Anderson.

"We're still on forecasts and off to a good start," he added.

The holiday season is crucial for retailers because that is when they make the most revenue and a big chunk of their earnings.

Thanksgiving and the days following, which include what is traditionally the busiest online shopping day, Cyber Monday, are more important this year as retailers lure consumers with earlier promotions.

"This trend could drive a disproportionately higher percent of overall holiday spending to the first half of the period," Brian Pitz and Brian Fitzgerald, Internet analysts at Jefferies, said. "Heavy promotions would be needed later on to achieve the growth rates of last year."

Starting on Thanksgiving, Wal-Mart will send early online deals to customers who connect with the retailer via email, Facebook or by downloading its mobile shopping application to their smartphones.

The spread of mobile devices, such as smartphones and tablet computers, will also drive online sales growth this holiday, analysts said.?

J.P. Morgan's Anmuth estimates that mobile shopping will account for 12 percent of holiday e-commerce spending in the United States in the fourth quarter, up from 3 percent in the same period of 2010 and 9 percent last holiday season.

Some mobile shopping represents a transition from personal computers to smartphones and tablets, rather than extra spending. However, Anmuth said the rise of mobile devices is fueling a faster switch to online commerce from physical retail.

Free shipping will also be a major driver of online sales growth this holiday, according to Anmuth and others.

More than half of consumers will abandon online shopping carts if they have to pay for shipping, recent data from comScore Inc showed.

Retailers have responded by offering more free shipping for online purchases. Between 50 and 60 percent of online transactions this holiday will come with free shipping, according to Shawn Milne, an analyst at Janney Capital Markets.?

Ukraine opposition warns Yanukovich, vows to free Tymoshenko

KIEV (Reuters) - Ukraine's re-energized opposition on Monday threatened President Viktor Yanukovich with impeachment and vowed to work to free ex-prime minister Yulia Tymoshenko from jail as they set out an action program for the new parliament.

The three parties, which include Tymoshenko's Batkivshchyna (Fatherland), far-right nationalists and a liberal party headed by boxing champion Vitaly Klitschko, made their call in a joint statement in which they grudgingly accepted the results of the disputed October 28 election.

The opposition's bold move, in which they swore to defeat "the regime of Yanukovich", raised the political temperature on the eve of a possible resumption on Tuesday of a second trial of Tymoshenko in the eastern city of Kharkiv.

But final election figures show that Yanukovich's Party of the Regions seems set to hang on to a majority in the 450-seat parliament - with the help of traditional allies - and it should be able to hold the opposition at bay in the new parliament.

The election in the former Soviet republic, mid-way through Yanukovich's five-year presidential term, has been criticized as flawed by international observers.

Despite the international criticism and street protests by the opposition, the election's outcome is likely to be used by Yanukovich as a springboard from which to launch a second bid for presidential office in 2015.

The three opposition parties, which made a strong showing and secured 178 parliament seats despite the absence of Tymoshenko, now appear to have agreed to take up their place in parliament even though they are still contesting voting in a few electoral districts.

Yanukovich's pro-business Regions, which is financed by wealthy industrialists, says it alone can provide stability in Ukraine, a major exporter of steel and grain.

The three opposition parties, which include the Svoboda (Freedom) Ukrainian nationalist party and Klitschko's UDAR (Punch), say his rule will extend corruption and cronyism, and relations with the West will deteriorate further.

The European Union has frozen a free trade agreement with Ukraine over the Tymoshenko affair.

IMPEACHMENT LAW

In their statement, the opposition parties vowed to work for a law under which Yanukovich could be impeached - something which has been actively blocked by Regions deputies in parliament - and for the resignation of the Yanukovich government and police and justice chiefs.

Opposition parties - particularly Batkivshchyna and Svoboda - reproach Yanukovich for signing an agreement with Russia in April 2010, shortly after he came to power, which extended the base rights of Russia's Black Sea fleet in Ukraine's Crimea until 2042.

"The resignation of the President, the government and the state prosecutor: these are our three main political tasks," Arseny Yatsenyuk, who heads Batkivshchyna in the absence of Tymoshenko, told a crowd of about 1,000 opposition supporters on Monday night.

"The very fact that three political forces have agreed to a joint start means that the opposition train has set off towards a new, honest, European country," Svoboda leader Oleh Tyahnibog declared to the same crowd in front of the Kiev headquarters of the central electoral commission.

The opposition also pledged to secure the freedom of Tymoshenko, 51, who was jailed in October 2011 for abuse of office after a trial which she said was a vendetta by Yanukovich, who beat her narrowly for the presidency in February 2010. The West has denounced her case as 'selective justice'.

Tymoshenko, a leading light in the "Orange Revolution" protests of 2004-5 which doomed Yanukovich's first bid for the presidency, is now on hunger strike in Kharkiv in protest at what she says was gross electoral fraud by the Regions.

A second trial on equally serious charges of embezzlement and tax evasion is due to resume against her on Tuesday, though there is a strong possibility the hearing may be postponed.

Her supporters called on her to end her hunger strike.

"We ask you Yulia: don't continue your hunger strike ! We need you strong, alive and healthy," declared Yatsenyuk to the crowd on Monday.

Despite the appearance of unity, the three opposition leaders have differences among themselves which could yet doom their partnership. Svoboda's Tyahnibog and UDAR's Klitschko are particularly known to be on poor terms with each other.

DePaolo&#39;s Work Comp World: Reflecting the New Economy: Culture ...

How much does a company's culture affect the business' workers' compensation experience? I'd venture to say a whole lot more than most people give credit.

At the?National Workers' Compensation and Disability Conference and Expo at the Las Vegas Convention Center last week?columnist and author on workers? compensation issues,?Peter Rousmaniere,?previewed a 100-page analysis and research report on ?The Texas Experience and the Oklahoma Proposal.?

While his overall conclusion was that?the ability to opt out of the Texas workers? compensation system ?has produced significant results,? such an option is not for everyone, and in fact is for very few - those who's cultures are already vested towards a strong employee benefit system.

"For employers with well-developed employee benefits programs, an opt-out program will fit into the culture of these programs," Rousmaniere said. "The ability to choose private or public workers? compensation means that the employer gets the solution that fits their needs."

"Customization of work injury benefits can match the needs of the employer?s workforce and location ? something that?s impossible with statutory workers? compensation," Rousmaniere said.

But,?"a strong opt-out program requires special expertise especially from workers? compensation administrators, benefits consultants, claims managers, brokers and excess insurers, and medical providers"?Rousmaniere said. "The old ways won?t work."

And there's the rub: the old ways won't work. Culture is deeply rooted into the ability of any employer to deliver benefits effectively and economically,?whether via non-subscription or traditional workers' compensation. So an opt out program is only going to work for those employers who already have workers' compensation systems that are timely, expedient and efficient.

I think Texas makes a great case study because it offers not only a comparison between an ERISA backed non-subscription system versus a traditional work comp insurance program from the employer-employee perspective, but it also gives us a glimpse how market reactions can foster overall change.

ERISA backed non-subscription has been around in Texas for several decades now, and participation has waxed and waned with the fluctuations in the traditional work comp market.

The "Survey of Employer Participation in the Texas Workers? Compensation System" for 2010 showed the percentage of employers that are nonsubscribers decreased from 33% in 2008 to 32% in 2010. The survey, conducted by the Texas Department of Insurance?s Workers? Compensation Research and Evaluation Group, shows the nonsubscription rate peaked at 44% in 1993 and 1995.?

The percentage of Texas employees working for nonsubscribers fell from 25% in 2008 to 17% in 2010. The lowest rate shown in the study was 16% in 2001. The Research and Evaluation Group is to release a new study updating the 2010 study by Dec. 1. I don't know how many of these non-subscribers have alternative benefit plans in place.

According to the??Insurance Council of Texas,?workers' compensation premium rates have dropped 49% since 2005, the year that the state's big reform bill, HB 7, came into effect introducing numerous changes that significantly affected the cost of medical delivery and indemnity benefits. This correspondes, albeit not by a large amount, to the decline in non-susbscription.

But I think this shows that employers speak with their wallets, essentially introducing market competition in an alternative of a traditional system.

It can't be said that opting out in itself forced the changes to Texas' work comp market, but certainly the ability of large employers to do so does affect the economics of the system. With the diversion of all those premium dollars, carriers, and those who provide support to the system, are going to look towards changes that increase efficiency in order to compete for those insurance dollars that may otherwise get diverted to ERISA backed plans.

A similar market based pressure may occur in California. While the Golden State is far from ever embracing an opt-out program, SB 863 introduced significant changes to the self-insured program that is going to result in huge savings to those employers that are big enough to host such programs. The more businesses that go for self-insurance means the more premium dollars that are diverted from traditional insurance providing some market competition.

But self-insurance is not the same as ERISA backed opt out programs because self-insureds still need to play by the same game rules as those under traditional insurance.

Still, I think that at least the large employer market is speaking loud and clear: make changes to corral medical and indemnity expenses or we'll take our premium dollars elsewhere.

Now that I think about it, perhaps ERISA backed opt-out is not so far from a reality in a big state like California. It sure came awfully close to reality in Oklahoma on the first try and that is a radical departure from tradition in a single legislative session.

While a Texas style opt-out program is not the panacea for issues within the industry, companies with strong employee benefit cultures, like those in California who pushed for self-insurance reform in SB 863, are going to look at?Rousmaniere's report, and look at what happens in Oklahoma. If it appears beneficial, we may see the next wave of reform following this radical departure as business-worker relations evolve to reflect this new economy.

Surveying Earth's interior with atomic clocks

ScienceDaily (Nov. 12, 2012) ? Have you ever thought to use a clock to identify mineral deposits or concealed water resources within the Earth? An international team headed by astrophysicists Philippe Jetzer and Ruxandra Bondarescu from the University of Zurich is convinced that ultraprecise portable atomic clocks will make this a reality in the next decade. The scientists argue that these atomic clocks have already reached the necessary degree of precision to be useful for geophysical surveying. They say that such clocks will provide the most direct measurement of the geoid -- Earth's true physical form. It will also be possible to combine atomic clocks measurements to existent geophysical methods to explore the interior of Earth.

Determining geoid from general relativity

Today, the Earth's geoid -- the surface of constant gravitational potential that extends the mean sea level -- can only be determined indirectly. On continents, the geoid can be calculated by tracking the altitude of satellites in orbit. Picking the right surface is a complicated, multivalued problem. The spatial resolution of the geoid computed this way is low -- approximately 100 km.

Using atomic clocks to determine the geoid is an idea based on general relativity that has been discussed for the past 30 years. Clocks located at different distances from a heavy body like our Earth tick at different rates. Similarly, the closer a clock is to a heavy underground structure the slower it ticks -- a clock positioned over an iron ore will tick slower than one that sits above an empty cave. "In 2010 ultraprecise atomic clocks have measured the time difference between two clocks, one positioned 33 centimeters above the other," explains Bondarescu before adding: "Local mapping of the geoid to an equivalent height of 1 centimeter with atomic clocks seems ambitions, but within the reach of atomic clock technology."

Geophysical surveying with atomic clocks

According to Bondarescu, if an atomic clock is placed at sea level, i.e., at the exact altitude of the geoid, a second clock could be positioned anywhere on the continent as long as it is synchronized with the first clock. The connection between the clocks can be made with fiber optics cable or via telecommunication satellite provided that the transmission is reliable enough. The second clock will tick faster or slower, depending on whether it is above of beneath the geoid. The local measurement of the geoid can then be combined with other geophysical measurements such as those from gravimeters, which measure the acceleration of the gravitational field, to get a better idea of the underground structure.

Mappings possible to great depths

In principle, atomic clock surveying is possible to great depth provided that the heavy underground structure to be studied is large enough to affect the tick rates of clocks in a measurable manner. The smallest structure that atomic clocks accurate to 1 centimeter in geoid height can determine is a buried sphere with a radius of about 1.5 kilometer buried at 2 kilometers under the surface provided it has a density contrast of about 20% with the surrounding upper crust. However, scientists estimate that the same clocks would be sensitive to a buried sphere with a radius of 4 kilometers at a depth of about 30 kilometers for the same density contrast.

Currently, ultraprecise atomic clocks only work in labs. In other words, they are not transportable and thus cannot be used for measurements in the field. However, this is all set to change in the next few years: Various companies and research institutes, including the Centre Suisse d'Electronique et de Microtechnique CSEM based in Neuch?tel, are already working on the development of portable ultraprecise atomic clocks. "By 2022 at the earliest, one such ultraprecise portable atomic clock will fly into Space on board an ESA satellite," says Professor Philippe Jetzer, the Swiss delegate for the STE-Quest satellite mission aimed at testing the general relativity theory very precisely.

As early as 2014 or 2015, the "Atomic Clock Ensemble in Space ACES" is to be taken to the International Space Station ISS. ACES is an initial prototype that does not yet have the precision of STE-QUEST.
